Dubai Issues Decree to Enhance National Talent in Judicial Authorities
In a significant move to bolster national talent within Dubai's judicial system, His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, has issued Decree No. (49) of 2024.
This Decree regulates the appointment of Dubai Government employees as members of the emirate's judicial authorities.
The primary aim of the Decree is to attract qualified Emirati nationals to judicial roles while ensuring that their legal status, rights, and financial entitlements are preserved during their training at the Dubai Judicial Institute. The training includes a comprehensive Judicial and Legal Studies Programme for judges and a Diploma in Legal and Judicial Sciences for Public Prosecutors. Notably, employees will retain their positions within their current government entities while participating in the training.
The provisions apply to both civilian and military employees governed by existing human resource regulations, such as Law No. (6) of 2012 and Law No. (8) of 2018. However, Directors General and CEOs governed by specific laws are exempt from these provisions.
Key stipulations of the Decree include full monthly salary retention during training, with eligibility contingent upon being a UAE national and meeting the admission requirements outlined in Law No. (13) of 2016. Employees must adhere to the Dubai Judicial Institute's guidelines, and upon successful program completion, they will be required to serve in a judicial authority for a minimum of five years.
The Decree also specifies that failure to fulfill this commitment necessitates the repayment of salaries received during training. This Decree is effective immediately upon publication in the Official Gazette, marking a proactive step towards enhancing the legal framework in Dubai.
