UAE: Are Managers Entitled to Compensation for Working on National Day Holidays?

Question: I hold a managerial position at a company in mainland Dubai and worked during the National Day break. While I understand I may not be entitled to compensatory time off, are there any other benefits or compensation I can receive for working on a public holiday?

Answer: In the UAE, employees are entitled to public holidays as declared by the Ministry of Human Resources and Emiratisation (MoHRE), as per Article 28(1) of the Federal Decree Law No. 33 of 2021, which states that employees are entitled to full pay on official holidays determined by the Cabinet.

If an employer requires an employee to work on a public holiday, the employee must either be granted compensatory leave or receive additional compensation. This includes a supplement of at least 50% of the employee's basic salary for that day, as per Article 28(2) of the Employment Law.

Even though you hold a managerial position, you are still entitled to compensatory leave or additional salary for working on public holidays. You may wish to discuss this with your employer and request either compensatory time off or extra pay for working during the National Day break. If an amicable resolution cannot be reached, you have the option to seek assistance from MoHRE to address the issue.
