UAE: Can You Decline a Job Offer After Accepting It via Email?

Question: I received a job offer from a Dubai-based company and accepted it via email but did not sign any contract. Now, I have a better offer from another company. Will I face any legal trouble if I decline the first offer?

Answer: In the UAE, employment agreements are regulated by the Ministry of Human Resources and Emiratisation (MoHRE) under Ministerial Decree No. 46 of 2022 and Federal Decree-Law No. 33 of 2021. The legal enforceability of a job offer depends on whether it has been formalized into a contract.

  • Job Offers & Employment Contracts:
    As per Article 2(1) of Ministerial Decree No. 46 of 2022, a job offer must align with the standard employment contract. However, until an offer letter is signed and registered as an official MoHRE contract, it is generally not legally binding.
  • Legal Binding of a Contract:
    Article 8(1) of Federal Decree-Law No. 33 of 2021
    states that an employment contract must be signed by both parties, with each receiving a copy. Since you have not signed a formal contract, you are not legally obligated to join the company.
  • Can an Employer Force You to Work?
    Under Article 14(1) of the UAE Labour Law, no employer can force an individual to work against their will. This means that even if you have accepted the offer via email, the company cannot legally compel you to take the job.

While an email acceptance might be seen as an agreement under some UAE contract laws, it typically does not hold the same weight as a signed employment contract.
