UAE: Can You Legally Work on a Visit Visa?
Question: Can I begin working for a mainland company in the UAE after accepting a job offer but before my work permit/visa is processed?
Answer: In the UAE, it is illegal to work without a valid work permit and residency visa. Under Article 6(1) of Federal Decree Law No. 33 of 2021, no individual may work or be employed without obtaining a work permit from the Ministry of Human Resources and Emiratisation (MoHRE). Additionally, Article 5(4) of Federal Decree Law No. 29 of 2021 prohibits expatriates from engaging in any employment without a valid work permit and residency visa.
Employers and employees must ensure that the appropriate work permit is obtained before starting any employment. These permits may include full-time, part-time, temporary, or freelance work permits as outlined in Article 6 of Cabinet Resolution No. 1 of 2022.
Working without a valid permit can lead to severe penalties for both the employer and the employee. According to the law, employers may face fines ranging from AED 100,000 to AED 1,000,000 if they recruit someone without the necessary work permit and visa.
Therefore, you should not begin working while on a visit visa. Your employer must obtain a valid work permit and UAE residency visa before you start employment.
