Navigating employee leave policies in the UAE can be complex. If you're considering extending your leave beyond the approved period without your employer's consent, you could face serious consequences, including termination. Understanding your rights and the legal framework around leave extension is crucial to avoid potential conflicts with your employer. This article outlines the key regulations and what you need to know about extending your leave in the UAE.

Question: I am on leave in my home country and need to extend my leave due to family commitments. My boss is refusing the extension. Can he reject my application if I have enough leave left? Can he fire me if I extend my leave without approval?

Answer: In the UAE, after completing one year of service, employees are entitled to 30 days of annual leave each year, as per Article 29 of the Federal Decree Law No. 33 of 2021. Employers have the discretion to approve or deny leave extensions based on work requirements.

If you extend your leave without approval, you risk not being paid for the extended period (Article 34). Moreover, if absent for more than seven consecutive days without a valid reason, your employer can terminate you without notice (Article 44).

You may present valid documentation to justify your extended leave to your employer. However, extending leave without approval can result in salary loss or termination. In case of termination, you can challenge it if you have legitimate reasons and documentation.
