In the UAE, both traditional smoking and vaping in enclosed public spaces and workplaces are illegal under federal tobacco control laws. Despite this, some employees believe that vaping is exempt from these restrictions, leading to the widespread use of e-cigarettes in office settings. This misconception has prompted legal experts and health authorities to clarify that anti-smoking laws indeed apply to vaping.
Legal Implications of Vaping in Offices
Mahmoud Kreidie, a lawyer at Ahmad Bin Hezeem and Associates LLP, emphasized that vaping in offices and other enclosed public spaces is prohibited.
"In the UAE, smoking, including vaping, is prohibited in enclosed public spaces and workplaces under federal law on tobacco control."
This ban also extends to common areas such as lobbies and parking zones. Violations can result in immediate fines of Dh500, with more severe penalties for serious or repeat offenses.
Employee Perspectives and Office Policies
Some employees continue to vape despite the regulations, assuming it is permissible. One UAE resident, an accountant at a leading Dubai firm, admitted to vaping in her office to avoid frequent trips outside. Another IT specialist employee echoed this sentiment, stating that as long as colleagues do not mind, he sees no harm in it. However, this behavior can be offensive and inconsiderate, especially to those with respiratory issues like asthma, as highlighted by a marketing executive named Fatima.
Ministry of Health and Prevention (MoHAP) Guidelines
To combat this issue, the UAE’s Ministry of Health and Prevention (MoHAP) has called on companies to enforce strict no-smoking policies, including vaping. In June, MoHAP urged private entities to adopt and enforce tobacco-free policies and take disciplinary actions against employees who violate these rules. The ministry has also advised integrating the tobacco-free policy into professional performance documents and developing clear, written procedures for compliance and non-compliance.
UAE's anti-smoking laws clearly apply to both traditional smoking and vaping in office settings. Companies are encouraged to enforce these regulations strictly to ensure a safe and healthy work environment for all employees.
By understanding and adhering to these rules, employees can help maintain a considerate and legally compliant workplace, free from the risks associated with second-hand smoke.
