If a developer fails to fulfill the Sale Purchase Agreement (SPA) terms, the buyer can request compliance and, if necessary, file a complaint with the DLD. Real Estate Regulatory Agency (RERA) has the authority to cancel a project if a developer fails to fulfill conditions, and the developer must refund all payments made by buyers, according to Article 23 of Executive Council Resolution No. 6 of 2010. If the developer fails to refund amounts owed within the specified period, RERA takes necessary actions to preserve buyers' rights, including legal referral, as per Article 27 of Executive Council Resolution No. 6 of 2010.

    Additionally, DLD has introduced the Oqood system for online registration and tracking of off-plan sales contracts. This service facilitates the convenient registration process for various real estate and property-related contracts between buyers and developers in the off-plan market.

    Developers are also required to open escrow accounts for each project. This ensures funds are released only at predefined construction milestones, providing financial security to buyers.
